Terms and Conditions
Version July 2025 – applicable to the use of MyAutoUp.com
These terms and conditions apply to the use of the MyAutoUp platform, and reachable via info@myautoup.com.
1. Definitions
- MyAutoUp: The online service provider that facilitates car sales between private sellers and certified car buyers.
- User: Any person making use of the services offered by MyAutoUp.
- Buyer: RDW-certified dealer or vehicle buyer who places bids on listed cars.
- Platform: The MyAutoUp.com website where users can submit vehicle information and receive offers.
2. Services
- Users may submit their vehicle by entering their license plate and additional details.
- Within 24 hours, users receive non-binding offers from certified buyers.
- The user decides whether or not to accept an offer.
- MyAutoUp only facilitates the initial connection and is not a party to the final sales agreement.
3. User Responsibilities
- The user is responsible for providing accurate and complete information about the vehicle.
- The vehicle must be owned by the user and free of encumbrances or legal issues.
- If the vehicle turns out to be unavailable after an offer is accepted, MyAutoUp reserves the right to block the user from further participation.
4. Buyer Responsibilities
- All bids must be fair and binding, provided the vehicle matches the submitted description.
- The buyer is responsible for proper and timely handling after a bid is accepted.
5. Costs and Payments
- Use of the MyAutoUp platform is completely free and non-binding for private users.
- All payments and agreements take place directly between buyer and user, outside the platform.
6. Liability
- MyAutoUp is not liable for any damage resulting from agreements between user and buyer.
- MyAutoUp does not guarantee a sale or a minimum price.
- Technical issues or downtime do not give rise to compensation claims.
7. Privacy and Data Processing
- Personal and vehicle data are processed in accordance with the privacy policy of MyAutoUp.
- Information is shared only with certified buyers for the purpose of submitting bids.
8. Intellectual Property
- All rights to texts, visuals, logos, and software on the platform belong to MyAutoUp or its licensors.
- Use of (parts of) the website without written permission is prohibited.
9. Changes to the Terms
- MyAutoUp reserves the right to modify these terms and conditions at any time.
- Changes will be announced through the platform and take effect immediately.
10. Governing Law and Disputes
- These terms are governed exclusively by Dutch law.
- Any disputes will be submitted to the competent court in the district of Rotterdam, The Netherlands.
